TERMS & CONDITIONS
Please read these Terms & Conditions carefully. By making a booking or engaging Auckland Belly Dance Ltd (“Auckland Belly Dance”, “we”, “us” or “our”), you (“the Client”) agree to these Terms & Conditions.
These Terms & Conditions apply to all performances and related services provided by Auckland Belly Dance unless otherwise agreed in writing.
Nothing in these Terms & Conditions is intended to exclude or limit any rights or remedies that cannot legally be excluded, including rights that may apply under the New Zealand Consumer Guarantees Act 1993 or other applicable legislation.
1. BOOKING & PERFORMANCE DETAILS
1.1 Booking confirmation
A booking is considered confirmed once:
(a) the Client has accepted the quoted price and agreed to the performance details; and
(b) the required deposit has been received.
The booking confirmation will normally specify the event date, venue, performance time, performance duration, agreed fee, and any additional services or requirements.
Any changes to these details must be agreed in writing.
1.2 Performance time
The Client is responsible for ensuring that the performance can begin at the agreed time.
Auckland Belly Dance may have other engagements before or after the Client’s event. Delays caused by the Client, venue, guests, speeches, ceremonies, catering, or other event activities may therefore affect the performance.
If the performance has not commenced within 30 minutes of the agreed time due to circumstances within the Client’s or venue’s control, a $50 waiting fee may apply.
If the delay is substantial, Auckland Belly Dance reserves the right to shorten the performance or, where continuing is no longer reasonably possible, treat the booking as cancelled by the Client.
Any additional waiting, travel, or performance-related charges will be communicated to the Client where reasonably practicable.
2. CLIENT & VENUE RESPONSIBILITIES
The Client is responsible for ensuring that the venue and event are suitable for the agreed performance.
2.1 Safe performance space
The Client must provide a safe, unobstructed and suitable performance area. The area must be:
(i) clear of furniture and other obstacles;
(ii) free from broken glass, spilled liquids and other hazards;
(iii) free from low-hanging objects or other obstructions;
(iv) suitable for the type of performance booked; and
(v) adequately lit where necessary for the safety of the performer.
The Client must inform Auckland Belly Dance in advance of any unusual venue conditions, including outdoor surfaces, uneven flooring, stairs, restricted access, low ceilings, or other potential hazards.
Auckland Belly Dance may refuse to perform, modify the performance, or leave the venue if the performance area or surrounding environment is considered unsafe.
2.2 Respectful and harassment-free environment
The Client is responsible for ensuring that the performer is treated respectfully and that the event environment is free from sexual harassment, intimidation, threatening behaviour, unwanted physical contact, discrimination, or other inappropriate conduct.
The performer is not required to tolerate harassment or unsafe behaviour from the Client, guests, venue staff, or any other person present at the event.
If the performer reasonably considers the environment unsafe, threatening, or inappropriate, they may stop or decline the performance and leave the venue.
Where the circumstances are caused by the Client, their guests, or the venue, the agreed performance fee remains payable.
2.3 Changing and personal belongings
The Client must provide a private, secure and suitable area for the performer to change clothing and store personal belongings during the performance.
The Client, or a designated person acting on behalf of the Client, must show the performer this area upon arrival.
Auckland Belly Dance is not responsible for loss or damage to personal belongings where reasonable care has been taken.
2.4 Sound system and music
The Client is responsible for providing an adequate sound system capable of playing music from a USB drive at a suitable volume.
The sound system must be appropriate for the size and type of venue.
The music has been professionally edited for the show and may not be available for streaming through online music services.
If the Client requires access to the music before the event, this must be requested at least one week before the performance.
Auckland Belly Dance may be able to provide a portable speaker where necessary. This speaker is intended for smaller venues and is not suitable for large events. A request for the speaker must be made in advance.
The Client is responsible for ensuring that any venue-specific sound requirements are communicated before the event.
2.5 Special requests and changes
The performance is planned in advance, including music selection, choreography, costumes and performance structure.
Special requests, song requests, changes to choreography, audience participation requirements, or other significant alterations must be communicated at least 1–2 weeks before the event.
Auckland Belly Dance cannot guarantee that requests made on the day of the event can be accommodated.
Last-minute changes may incur an additional fee where they require substantial preparation or changes to the agreed service.
2.6 Venue access and parking
The Client is responsible for ensuring reasonable access to the venue for the performer.
Where applicable, the Client must provide or arrange suitable parking or advise Auckland Belly Dance of available parking arrangements in advance.
Any venue access fees, parking charges, tolls, permits, or other event-related costs that were not included in the original quotation may be payable by the Client if agreed in advance.
3. TIPS
Tips are welcomed but are entirely optional.
Guests may tip the performer by handing tips directly to her or, where appropriate and safe, by placing or throwing notes above the performer’s head.
Tips should not be thrown in a manner that creates a safety hazard.
Tips received by the performer belong entirely to the performer and are separate from the agreed performance fee. They are not deducted from the Client’s outstanding balance.
4. PERFORMER RESPONSIBILITIES
Auckland Belly Dance will use reasonable care and skill in providing the agreed performance services.
If the performer experiences an unexpected delay while travelling to the event, they will contact the Client using the contact details provided at the time of booking as soon as reasonably practicable.
Where appropriate to the performance booked, audience participation may be incorporated into the show. Guests of honour may be invited to participate, but no guest will be forced to participate.
Auckland Belly Dance may be accompanied by an assistant. An assistant may be required for reasons including costume changes, performer security, event logistics, or safety monitoring during specialised performances.
5. SUBSTITUTION, ILLNESS & EMERGENCIES
If the scheduled performer becomes unable to perform due to illness, injury, accident, emergency, or another legitimate circumstance beyond their reasonable control, Auckland Belly Dance may:
(a) arrange a suitable replacement performer where reasonably possible;
(b) reschedule the performance by agreement; or
(c) cancel the performance and refund any amounts paid for services that will not be provided.
Where a suitable replacement performer is offered and accepted by the Client, the booking will continue on the agreed terms.
6. SPECIALISED & FIRE PERFORMANCES
Additional safety requirements apply to fire performances and other specialised performances.
Auckland Belly Dance reserves the right to decline or modify a fire performance where the venue, weather, surface, audience arrangement, available space, or other circumstances are unsuitable or unsafe.
The Client is responsible for obtaining any required venue approval or permission for a fire performance and must disclose any venue restrictions in advance.
Auckland Belly Dance may require additional safety measures, exclusion zones, lighting, ventilation, fire-safety equipment, or other conditions depending on the performance and venue.
If a fire performance cannot safely proceed, Auckland Belly Dance may substitute another performance where reasonably practicable.
7. PHOTOGRAPHY, VIDEO & RECORDING
Guests and the Client may photograph or record the performance for personal, non-commercial use.
Commercial use, advertising, promotional use, paid content, resale, publication, or use of recordings in connection with a business requires Auckland Belly Dance’s prior written permission.
The Client must not edit, manipulate, or use recordings in a manner that is misleading, defamatory, sexually explicit, or reasonably likely to damage the reputation of the performer or Auckland Belly Dance.
Auckland Belly Dance may separately request permission from the Client or event organiser to photograph or record the performance for its own promotional purposes.
8. FEES & PAYMENT
8.1 Deposit
A 30% deposit is required to secure the booking unless otherwise stated in the quotation.
The booking is not confirmed until the deposit has been received.
The deposit will be applied toward the total performance fee.
8.2 Balance
The remaining balance is due 7 days before the scheduled performance, unless otherwise agreed in writing.

Cash payments on the day of the event are not accepted.
8.3 Additional charges
Additional charges may apply where the Client requests services or changes that were not included in the original quotation, including additional performance time, significant last-minute changes, additional travel, waiting time, specialised requirements, or other agreed services.
Any additional charges will be communicated to the Client where reasonably practicable.
9. CANCELLATION & RESCHEDULING BY THE CLIENT
The Client should notify Auckland Belly Dance as soon as possible if an event needs to be cancelled or rescheduled.
More than 7 days before the event
Where a Client cancels more than 7 days before the scheduled performance, the deposit will ordinarily be retained to cover the reservation of the date and preparation already undertaken, unless otherwise agreed or required by law.
7 days or less before the event
For cancellations made 7 days or less before the scheduled performance, a cancellation charge of 50% of the total agreed service fee may apply.
Within 24 hours of the event
For cancellations made within 24 hours of the scheduled performance, a cancellation charge of up to 100% of the agreed service fee may apply.
The applicable cancellation charge is intended to reflect the loss of the reserved date, preparation undertaken, and difficulty of replacing the booking at short notice.
Where the Client wishes to reschedule rather than cancel, Auckland Belly Dance may, at its discretion, transfer some or all of the amount already paid to a new date, subject to availability and any difference in pricing.
Any cancellation or rescheduling must be confirmed in writing.
Nothing in this clause limits any rights the Client may have under applicable New Zealand law.
10. CANCELLATION OR NON-PERFORMANCE BY THE CLIENT
The Client must comply with the venue, safety, payment and other requirements set out in these Terms & Conditions.
If the Client fails to provide a safe and suitable environment, fails to make required payments, prevents the performer from reasonably providing the agreed service, or otherwise materially breaches these Terms & Conditions, Auckland Belly Dance may decline to perform or terminate the booking.
Where non-performance is caused by the Client or circumstances within the Client’s control, the agreed fee may remain payable.
11. FORCE MAJEURE
Neither party will be liable for a failure or delay in performing their obligations where the failure is caused by circumstances beyond their reasonable control.
This may include severe weather, natural disasters, fire, epidemic or pandemic restrictions, significant transport disruption, venue closure, government restrictions, civil emergency, or other circumstances that make performance impossible or unsafe.
Where a force majeure event occurs, the parties will endeavour to agree on a reasonable alternative, such as rescheduling or substituting the service where appropriate.
If the performance cannot reasonably be provided or rescheduled, any refund or payment obligations will be determined having regard to the circumstances, services already provided, expenses reasonably incurred, and applicable New Zealand law.
12. LIABILITY & SAFETY
Auckland Belly Dance takes reasonable steps to provide performances safely and professionally.
The Client remains responsible for the venue, event environment, guests, venue staff, and any hazards or conditions outside Auckland Belly Dance’s control.
The Client must promptly notify Auckland Belly Dance of any known safety concerns, venue restrictions, or hazards that could affect the performance.
Nothing in these Terms & Conditions excludes or limits liability to the extent that such exclusion or limitation would be unlawful.
13. COMMUNICATION
The Client is responsible for providing accurate contact information and a reliable contact person for the event.
The Client must promptly notify Auckland Belly Dance of any changes to:
(a) venue;
(b) event location;
(c) performance time;
(d) event schedule;
(e) contact details;
(f) sound arrangements; or
(g) other circumstances that may affect the performance.
Important changes should be communicated in writing.
14. AGREEMENT & AMENDMENTS
The quotation, booking confirmation, and these Terms & Conditions together form the agreement between Auckland Belly Dance and the Client.
Any amendment to the agreed performance details or these Terms & Conditions must be agreed in writing by both parties.
Verbal changes are not guaranteed to be accepted unless subsequently confirmed in writing.
15. GOVERNING LAW
These Terms & Conditions are governed by the laws of New Zealand.
Any dispute will first be addressed by the parties in good faith with the aim of reaching a reasonable resolution. Nothing in these Terms & Conditions prevents either party from exercising any rights or remedies available under New Zealand law.
16. CONSUMER RIGHTS
Nothing in these Terms & Conditions is intended to exclude, restrict, or modify any rights or remedies that cannot legally be excluded under New Zealand law.
Where applicable, the Consumer Guarantees Act 1993 provides consumers with guarantees relating to services, including that services will be carried out with reasonable care and skill and, where applicable, be fit for a particular purpose.
Where the Client is acquiring services for business purposes, the parties may agree in writing to contract out of certain provisions of the Consumer Guarantees Act where permitted by law.
17. ACCEPTANCE
By paying the deposit, confirming a booking, or otherwise engaging Auckland Belly Dance for a performance, the Client acknowledges that they have had the opportunity to read and understand these Terms & Conditions and agree to be bound by them.

(a) respond to enquiries and booking requests;
(b) provide quotes and arrange your booking;
(c) communicate with you about our services;
(d) process payments and maintain business records; and
(e) improve our services and website.

KEEPING YOUR INFORMATION SAFE
We take reasonable steps to keep your personal information secure and only allow access where it is needed for legitimate business purposes.
We keep information only for as long as reasonably necessary or as required by law.
PHOTOS & VIDEOS
Photos and videos may be taken at performances, events, classes or workshops. We may use images for promotional purposes where appropriate permission has been given.
If you have a concern about an image of you appearing on our website or social media, please contact us.
THIRD-PARTY SERVICES
We may use trusted third-party services to help operate our website and business, such as website hosting, payment, booking, email, accounting or analytics providers. These providers may receive information where necessary to provide their services to us.
Some providers may store information outside New Zealand.
YOUR RIGHTS
Under the Privacy Act 2020, you can ask us what personal information we hold about you and request that it be corrected if it is inaccurate.
